Terms of service

1. Who we are

Tappy (usetappy.app) is run by Casefmme LLC, an Ohio limited liability company (“we”, “us”). These terms are an agreement between you and us. They cover the Tappy website and app, and everything you make or export with them (together, “Tappy”). By creating an account or using Tappy, you agree to these terms, our privacy policy and our refund policy. If you don’t agree, please don’t use Tappy.

2. Your account

• You must be at least 18, or the age of majority where you live, to use Tappy.
• If you use Tappy for a company or other organisation, you confirm you’re allowed to accept these terms for it. In that case, “you” includes that organisation.
• Keep your sign-in secure. You’re responsible for what happens in your account, so tell us right away if you think someone else has access to it.
• Each account is for one person. Don’t share your account or sell access to it.

3. What Tappy does, and what AI can’t promise

Tappy uses AI models to turn your descriptions into app screens, clickable prototypes and code. AI output can be wrong, incomplete or similar to what other people get. That means:

• You’re responsible for checking designs and code before you use, publish or ship them. That includes checking accessibility, security, accuracy, legal requirements and app store rules.
• We don’t promise that output is unique, or that it doesn’t resemble existing apps or designs.
• We keep improving Tappy, so features may change, and we may add or remove them.

4. Your content and who owns it

“Your content” means what you put into Tappy, such as descriptions, reference images, brand details, fonts and comments. It also covers the designs, prototypes and code Tappy makes for you (“output”).

• You keep all your rights in what you put into Tappy. As between you and us, you own the output, and we assign to you any rights we have in it.
• Some parts of output belong to others and stay under their own licences, including fonts, icons, placeholder photos and avatars. Placeholder images are there to fill mockups, so replace them with images you have the rights to before you release your app.
• You confirm you have the right to use everything you upload or import, including fonts, images, logos and brands.
• You give us permission to host, copy, process and display your content only as needed to run Tappy for you. That includes sending it to the service providers listed in our privacy policy. This permission ends when you delete the content, apart from backup copies that expire on their normal schedule.
• We don’t use your content to train AI models, and we don’t sell it.

5. Share links and comments

A share link lets anyone who has it view that app and leave comments, and they can pass the link on. Only share links with people you’re happy to show your work to. Comments are visible to everyone with the link. You’re responsible for what you share and for the comments you leave. To take a share link down, contact us.

6. Acceptable use

Don’t use Tappy to:

• break the law, or help anyone else break it;
• make something meant to deceive people, such as a fake sign-in or payment screen, a scam, or a copy of another company’s app or brand used to pass yourself off as them;
• infringe anyone’s intellectual property, privacy or other rights;
• make content that sexualises minors, harasses people, promotes violence or is otherwise harmful;
• import a brand or website you don’t have the right to use;
• upload malware, or try to break, overload or probe Tappy, or get around its security, limits or billing;
• scrape Tappy or access it by automated means, except through features we provide;
• resell access to Tappy, or copy its interface or features to build a competing service.

You must also follow the usage policy of our AI provider, Anthropic. We may remove content, or suspend or close accounts, that break these rules.

7. Credits, plans and payment

• Tappy uses credits to pay for AI work. We may offer a free starting allowance, monthly plans that include credits, and one-off credit top-ups. Prices, what each option includes and whether its credits expire are shown before you buy.
• How many credits an action uses depends on how much AI work it takes. Where we can, we show an estimate before you start.
• Credits have no cash value, can’t be transferred or sold, and can only be used in Tappy.
• Plans renew automatically each billing period until you cancel. You can cancel at any time, and your plan stays active until the end of the period you’ve paid for.
• Stripe processes payments. Prices don’t include taxes unless stated, and we’ll add sales tax or similar taxes where the law requires.
• We may change prices. A new plan price applies from your next billing period, and we’ll email you before it does. If a payment fails, we may pause paid features until it’s sorted.

8. Refunds

Used credits can’t be refunded. Our refund policy explains when you can get money back, and what we do when something goes wrong on our side.

9. Other companies’ services

Tappy relies on other companies, which are listed in our privacy policy. When you sign in with Google or GitHub, or pay through Stripe, their terms apply too. We aren’t responsible for their services.

10. Ending your account

• You can stop using Tappy at any time. To delete your account, email hello@usetappy.app.
• We may suspend or close your account if you break these terms, or if your use puts Tappy, us or others at risk. We may also close accounts if we stop offering Tappy. Where it’s reasonable, we’ll tell you first and give you time to export your work.
• If we close your account, or shut Tappy down, and you haven’t broken these terms, we’ll refund your unused paid credits.
• Sections 4, 11, 12, 13 and 14 still apply after your account ends, along with any other terms that by their nature should continue.

11. Disclaimers

To the fullest extent the law allows, Tappy and all output are provided “as is” and “as available”, without warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don’t promise that Tappy will be uninterrupted, error-free or secure, or that output will be accurate or meet your needs.

12. Limitation of liability

To the fullest extent the law allows, Casefmme LLC and its members, employees and suppliers aren’t liable for any indirect, incidental, special, consequential or punitive damages. Nor are we liable for lost profits, revenue, data or goodwill arising from or related to Tappy or these terms, even if we were told they were possible. Our total liability for all claims about Tappy or these terms is limited to the greater of what you paid us in the 12 months before the claim arose, or US$50.

Some places don’t allow these limits, so they may not fully apply to you.

13. Indemnity

Someone may bring a claim against us because of your content, your use of output, or your breach of these terms or the law. If that happens, you’ll cover our reasonable losses and costs from that claim, including reasonable legal fees.

14. Governing law and disputes

These terms are governed by the laws of the State of Ohio and applicable US federal law, without regard to conflict-of-law rules. If you have a problem, please contact us first so we can try to sort it out. If we can’t, any dispute will be decided only in the state or federal courts located in Ohio, and you and we agree to their jurisdiction. Either of us may take a claim to small claims court instead, if it qualifies.

15. Changes to these terms

We may update these terms. If a change is significant, we’ll tell you by email or in Tappy at least 14 days before it takes effect. If you keep using Tappy after that, you accept the new terms.

16. General

• These terms, the privacy policy and the refund policy are the whole agreement between you and us about Tappy.
• If a court finds part of these terms can’t be enforced, the rest still applies. If we don’t enforce a right straight away, we haven’t given it up.
• You can’t transfer these terms to anyone else without our written permission. We may transfer them as part of a merger, acquisition or sale of our business.
